Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites and products of Zagaza Labs Inc. (“Zagaza Labs”, “we”, “us”), including Lumina (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

Zagaza Labs builds AI-powered products focused on health, behavior change, and everyday wellbeing. The Services are under active development and currently pre-launch. Features may change, be added, or be removed at any time, and availability is not guaranteed during preview or beta periods.

2. Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. If you create an account, you are responsible for the activity that occurs under it and for keeping your credentials secure. Provide accurate information and keep it up to date.

3. Not medical advice

The Services provide general wellness and habit-building support. They are not a medical device, do not provide medical advice, diagnosis, or treatment, and are not a substitute for the judgment of a qualified health professional. Always consult a physician or other qualified provider before making changes to your diet, exercise, medication, or health routines, and never disregard professional advice because of something the Services said. If you are experiencing a medical emergency, call your local emergency number.

4. AI-generated content

The Services use artificial intelligence to generate responses and recommendations. AI output can be inaccurate, incomplete, or unsuitable for your circumstances. You are responsible for evaluating any output before relying on it. We do not guarantee the accuracy of AI-generated content.

5. Acceptable use

You agree not to:

• Use the Services in violation of applicable law
• Attempt to probe, disrupt, or gain unauthorized access to the Services or their infrastructure
• Reverse engineer, scrape, or extract source code or underlying models except where the law permits it despite this restriction
• Use the Services to develop competing products or to train machine learning models
• Misrepresent AI output as professional medical guidance
• Interfere with other users’ use of the Services

6. Your content

You retain ownership of the content you submit to the Services. You grant us a limited license to host, process, and display that content as needed to operate and improve the Services, consistent with our Privacy Policy.

7. Our intellectual property

The Services, including software, design, branding, and content we create, are owned by Zagaza Labs and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from them.

8. Feedback

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.

9. Fees

The Services are currently offered without charge during pre-launch. We may introduce paid plans or subscriptions in the future. If we do, pricing and billing terms will be presented clearly before you are charged, and app-store purchases will be governed by the applicable app store’s terms as well.

10. Third-party services

The Services depend on third-party services such as app stores, authentication providers, and AI model providers. We are not responsible for third-party services, and your use of them may be subject to their own terms.

11. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access to the Services if you violate these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination will survive.

12. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

13. Limitation of liability

To the maximum extent permitted by law, Zagaza Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim arose or fifty US dollars.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page, and for material changes we will provide additional notice. Continuing to use the Services after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Zagaza Labs Inc. is incorporated, without regard to conflict of law principles. Disputes will be resolved in the courts of that jurisdiction unless applicable law provides otherwise.
